yes because they legally aren't your parents anymore. It's like getting disowned/disinherited, you can still see them afterwards (if they wanted to).

You can be an orphan if your parents are still alive. They give you away when you're a baby

Definition or orphan: Child who's parents are seperated from them by death or other means...considering the events that transpire afterwards, I don't think I'd call that an orphan. The only way that would make sense is AFTER he is returned to his father in the last one and after his father dies....which by the way HE DIDN'T KILL HIM EITHER!
