A scratch on the foiled side is worse than a scratch on the shiny side. You can scratch the shiny and still have the data but if you scratch the foil the data is gone forever.

The data is not written in the foil actually. You can google images of DVDs and CDs to see diagrams of both. Scratching the label would be ok as long as it's not deep enough to get at the recording layers. Deep scratches in general are bad, but surface ones on the shiny side might make it hard to read.
