Yes and no.
Only if operating a vehicle or with public intoxication laws. It's against the constitution to charge or arrest someone for being something. You can't arrest someone for being drunk or high at home, and can't be arrested for being an alcoholic, or a druggy, or a paedophile. You need to be in possession of something.
Because the officer clearly broke the chain of custody, the criminal could easily argue in court he never had drugs, and that the cop is lying. Beyond a reasonable doubt, don't forget.
If this was real, even if he were arrested, without evidence of his custody of the drugs I doubt the DA would waste his time pushing charges.
I mean arrest you maybe but since, they can't prove anything and have no physical evidence you can't be charged with anything. It's not like being drunk where they can just test with a breathalyzer.
They can't prove possession without the actual drugs either, because they can't prove it was actually an illegal substance if they don't physically posses it.
The legality is subject to local laws and going to court. Likely scenario is you'll be charged with 'Obstruction of justice' and possibly 'Tampering with evidence'.
The arresting officer isn't the one who decides if you are guilty or not, that would be up to the judge.
Now there are a lot of areas that are decriminalizing marijuana under a certain amount. You might just get away with a fine and/or a slap on the wrist.
Not where i live, got pulled with a friend and we had clearly smoked and it smelled like it, but we had nothing in the car or anything on us. The cop even asked us if we smoked before and we said yes, he searched the car and found no weed so let us go.

False. As a former military policeman we were trained extensively for cases such as this.
My own boss was fired from his position after walking in on a man who just killed his entire family. The clever murder asked my boss “CriminalSaysWhat?” And my boss responded “What?” Then arrested himself. The criminal went free and my boss was fired, then later killed himself. Sad day.

I mean, if he still arrests the kid then all of his officer buddies will find out that a stoner punked him.
evidence is still key in conviction though. Even if a cop watches you it's probable cause. Some places may force you to do a blood/ urine test to show you still "possess" some of it as ingested, but often times it isn't worth the officer's time. Especially for a first offense.

I had a buddy in VA who had an employee whose license got suspended unbeknownst to him. He got pulled over for speeding in a company van and when the cop told him that his license was suspended he pleaded with the cop to let him pull the van off the highway and park it at a Sheetz that was in sight. The cop gave in.
When he told that to my buddy he got a lawyer and the case was thrown out. VA has funny archaic laws.
"Being high" isn't actually illegal at all. It's all the possession that's illegal. Publicly? It can fall under intoxication laws; which, are a tad more complicated than they sound.
This case? Yeah no that guy is fucked.
In my state it's still considered possession if you have it in your system.
I've never seen it enforced ouutside of parolees going back to jail. Pissing hot at a job usually gets you fired or fucks with state/federal licensing, which is cheaper than dragging them to trial

Yeah, state to state is a whole other thing. I'm a bit surprised a state figured there were more laws needed. Makes some sense, but it is a little ridiculous since it can stay in your system so long.
in the UK even smelling of it is enough to arrest you, happened to my friend we were about to head out and along the road came a sniffer dog, random check, the dog smeleld weed so instant arrest, 4 hours later he came back with a caution.
