You are not allowed to drive at 2a.m. with a temporary license. At least here, but in America it would porbably be somewhat the same.

Here its 9 p.m. cut off, hence why I said it would work if you were drunk driving early enough in the evening. 2 a.m. is when bars here close however, and when I said they would still be suspicious. Suspicious, not immediately arresting, because I at least would assume the driver's ed teach forgot and left the sign on the car, not that it was a kid driving too late, thus suspecting the driver of being drunk for his drunken driving ways.

I don't know many student drivers that go out at night with those signs. And if you're drunk in the morning, then you might have a problem.
