Yeah, they are definitely ******* pirates. They've sunk hundreds of navy ships over the course of over 600 episodes. Just because they don't always take something with them doesn't mean they're not pirates.

They're more or less sailors for most of the show. Apart from fighting off the government (who are freaking evil anyways), they don't really do any plundering.

They're never the aggressors, they just defend themselves or help people out. If a merchant ship gets attacked and they manage to sink the enemy ship, it doesn't make them pirates.

They plunder the government and other pirates, although Nami is really the only one who is concerned about treasure. Every other crew member has their own reasons for wanting to be a pirate. Still, they roam the seas illegally, they steal things from a big boat, and they have cannons and a Jolly Roger on their ship. The only difference is that they don't plunder villages or merchant ships, not for any real moral reasons, but just because there's just not much to gain. Luffy has stated that he doesn't want to be a hero, but he has to keep moving further down the Grand Line and looting defenseless islands would only slow him down as well as earn him more enemies. He only attacks strong targets because he's only interested in becoming stronger.

Sorry for the exposition, but as a person who adores this show it bugs me when people assume they're "not really pirates" just because they don't burn and rape villages. Everyone in the show has their own reasons for becoming a pirate, it's only the small-time pirates that are satisfied with looting villages and getting fat and vulnerable from the spoils.
