because the dust cover(fire selector) isnt at the top behind the bolt and is currently in the fully automatic position.

Actually, it's in the semi-auto position.
On Kalashnikov rifles up is safe, middle is full-auto, and down is semi-auto.
That particular rifle is a formerly civilian legal Polytech/Norinco AK manufactured in China.
They can only fire in semi-auto and don't have a position for full-auto.

They were banned from importation and now they are quite expensive and collectible.
