For the moment it's being charged as rape because it's the closest equivalent.

Technically speaking the logic is that since rape is having sex with someone who hasn't given you permission to have sex with them. Since he was told to pull out, he did not have permission to be inside her vagina at the moment he was ejaculating.

Sure it's not 100% Rape rape, but since there's no law called Unlawful Insemination, it's the only charge available. Dude's probably gonna end up declared not guilty since it's such a massive stretch and sets a very dangerous precedent.

Just read the full article there.

I think the reason it's being classified as rape because of this:

"The ruling said: "She believed that he intended and agreed to withdraw before ejaculation. (He) knew and understood that this was the only basis on which she was prepared to have sexual intercourse with him.

"In short, there is evidence that he deliberately ignored the basis of her consent to penetration as a manifestation of his control over her."

Shortly after penetration - and without giving the woman "any chance to object" - the man had said he would be "coming inside her" and had added "I'll do it if I want"."

Rape doesn't necessarily involve force, just lack of consent, (slipping a roofie in someones drink, taking advantage of a passed out person, or if you want to get silly with it, ******* your twin brother's wife while pretending to be him.)

If a woman says essentially "I consent to sex on the condition that you pull out before ejaculating.", then the guy sticks it in her and says "I will ejaculate inside of you." then the consent naturally becomes void.

I think this case is special because the guy was so direct in his intent to violate her consent.

Actually, there are laws on verbal agreements. Agreeing not to come inside someone is part of the verbal contract, just as consent is. So, basically, it's consent with terms, and disrespecting the terms means breaching the contract and the immediate removal of consent.

It's an odd one.

If youre having trouble pulling out on cue you have some serious issues with self control. Its pretty obvious to feel when youre about to cum, so pulling out shouldnt usually be a problem. The reason you shouldnt do it as contraception is because precum can have semen in it aswell, also there is the risk of pulling out too late, seeing as you just said you cant. But saying that "noone can pull out on cue" is simply not true.

Well, not quite. If you tell her to not orgasm because it could get you pregnant and she acts aggressively in response and does it anyway, its not quite rape, but it is a criminal charge. Any male or female retains the right to take back consent during intercourse at any time and if the other party does not respect that and continues doing against their will, it IS rape. If a man tried to pull out at any time and the female wont let him, its a nonconsentual sex act. If a man continues intercourse after the female or other male tries to stop him, it is as well. Legally, forcing a sex act to keep going without to consent of the other party is rape. Personally I do not think this man should be punished in full but I dont think he should get away with a slap on the wrist- something like this would very likely cause emotional and mental distress to the woman, which is likely what she would receive damages for.

im canadian, the way it works here is that during sex. even consensual sex, that if she says no at any point, you have to stop.
