From Wikipedia----On March 13th 2013, "New Jersey’s Candy Treasure LLC" announced a new method of enclosing the toy. Each egg would feature a specially-designed capsule that separates the two halves of the chocolate so even a small child can see the there’s something on the inside. Thus circumventing the U.S. ban on “non-nutritive objects” that are encased entirely in food. These modified eggs are now considered legal in the united states. They are excepted to be available in U.S. stores for Easter 2013. Called "Choco Treasure", these are neither manufactured nor licensed by Ferrero, and Kinder Surprise eggs remain illegal in the U.S.

because american children are so fat/stupid, that they'l eat the entire thing in one go including the toys
#124 to #24 - treborsivad (03/16/2013) [-]
You aren't allowed to have inedible objects inside food for OBVIOUS reasons.
#139 to #24 - anon (03/16/2013) [-]
1.) you are/were a fat&studpid American kid
2.) you arnt American so you have it anyway and why the **** do you care.
3.) so that one kid in America was the only kid/human in history to choke on the toy in the whole world?
#62 to #24 - anon (03/16/2013) [-]
Actually the USA has a law that says you can't put non edible things in food.
User avatar #153 to #62 - sinonyx (03/17/2013) [-]
yeah, because before that law, some little kid probably died because of it

No, the way America works is that it only took one stupid, fat child to ruin it for the whole population.

User avatar #112 to #42 - WolfRider (03/16/2013) [-]

#123 to #112 - lafuriaroja (03/16/2013) [-]
The 1938 Federal Food, Drug, and Cosmetic Act contains a section highlighting that a confectionery product with a non-nutritive object, partially or totally imbedded within it, cannot be sold within the United States, unless the FDA issues a regulation that the non-nutritive object has functional value. Essentially, the 1938 Act bans “the sale of any candy that has imbedded in it a toy or trinket.”
User avatar #127 to #123 - WolfRider (03/16/2013) [-]
well i was able to buy them at a store for a long time

They might as well make lollipops with sticks illegal because some dumb ass kid will inhale the whole thing and choke. Why are we ******* with natural selection
User avatar #3 - krasisisback (03/15/2013) [-]
I remember when the wonder ball had toys inside. Then some stupid kid decided to try and eat the whole thing and choked on the toy.

User avatar #10 to #4 - travismackie (03/15/2013) [-]
No, they replaced the inside with candy instead, so the discontinuation is from something else... I think it was something to do with the company being bought, and closed down or something (don't take my word, because I'm not 100% sure).
User avatar #12 to #10 - icedmantwo (03/16/2013) [-]

mfw these were illegal in the first place is because of some soccer moms dumbass son tried to eat the whole thing in one bite and almost died

I believe the correct term is natural selection

while you have a point the simple reason is that the american government doesn't have a tax on kinder eggs. England is the same. we are totally fine with selling you dangerous chemicals that the government gets a slice of, but if they dont its probably not legal.
