The old man committed involuntary manslaughter, an example different form this would be if a man was laying down in the middle of the road to get run over, which is committing suicide, the driver will be held account able for not seeing the man laying in the middle of the road and would be charged with manslaughter. Same with the old man it wasn't the drivers intention to kill the man but he did it with out realizing he could, also anther force would he have killed both of them, another car or the ground but it didn't so the one responsible is the old man. I will respond to a retort if you have one.

If the mother had been shot instead of the son, who would be responsible for her death? The old man who was under the impression that he was threatening her with an unloaded gun or the son who purposely loaded the gun to have her shot and killed?

That would be a homicide charge for the son because it was his intention to kill the old lady to begin with, the old man would be responsible as an accomplice or charged for involuntary manslaughter but no one would probably judge the old man as guilty for his action.

the old man would still be convicted of murder because the old woman wouldn't be alive to verify his claim about it being a normal routine. you trust the legal system too much.
