A documented case of mental illness is not a requirement to be criminally insane. In fact, if you think about it, it's more likely that there wouldn't be one.

I apologize, but you are not qualified to predict the future in regards to his length of stay, as that will change depending on many different aspects of the mans recovery (if he ever does recover). Any speculation on the part of anyone but his doctors is just that, speculation.

Mental facility patients are often just as isolated as prisoners, especially the criminally insane and dangerous (for obvious reasons) with even less privileges then many prisoners. I do not presume to know the living conditions of every mental institution ever but I must question where you got such information. Mental institutions are comparable to prisons in a ridiculously large number of ways, so frankly I must disagree quite strongly with you here.

I'm not really sure what this case was supposed to prove to refute what I said, as that seems like a pretty clear case of someone being dangerously out of their goddamn mind.

There's also no time limit, meaning if they think you need it, they will keep you in the asylum for life, and until recently, asylums were horrible places to live. Considering you're still surrounded by potentially violent psychos, you aren't a whole lot safer either.

2. They have highly qualified doctors that evaluate the defendant. They don't get the insanity plea just because they claim the defendant is insane.

That doesnt mean that the risk of you going mentally ill or getting killed goes away. It might lower but not go away. Even if your the guy that sits in the big armoured truck flying the UAV, you can still see people get killed and theres nothing to say that truck can't get blown up. The only way your risk goes away of getting killed is if your in the Offices back in your country but you've still got the chance of getting pictures of people thats been shot etc to look at.

I wasn't really talking about a lower risk of getting killed but referring more about the chance of developing a mental illness from watching people die everyday. You're still at a high risk factor when working around any combat zone but the stress of being in constant peril or having someone killed everyday decreased dramatically if you were, say a mechanic or had some staff position. That's all I meant.

the ********* isn't about PTSD(Post Traumatic Stress Disorder) itself, but rather the way the US army deals with it.
unlike the EU the US doesn't have a treatment process when soldiers develop PTSD. they just get fired for no real reason without veteran privileges. so now those soldiers lost their healthcare insurance the army gave them and since they have a psychological disorder no healthcare insurance company is going to insure them.

it's this "throw them away and replace them with new ones" mentality that sickens people. like i said the army as well as the soldiers are aware they might develop PTSD, but they're also away they may get shot (which is slightly more worrying).

but you know the worst of all? when the army doesn't decide to throw away a soldier with PTSD they just send them on another deployment and jail them if they refuse to go.

Dude they make you get through that. They push everyone past their limit so 95% of people make it through bootcamp. It's almost not even an issue. Only kids who REALLY can't handle the pressure or physically aren't able don't get through. That's NOT very many.

I am an American and a Marine and what that grunt did still sickens me. I was deployed if Afghanistan twice, Iraq once. In Iraq, the first few days of the Battle of Fallujah were my last few days in country, my tour was up, but they sent my unit in as one last oorah and we were hit hard, I was hit twice, once in the leg and one grazed my ribs. The thing about Fallujah was that any man woman or child would suddenly pick up an AK and become your enemy. "Civilian Casualties" is no longer an accurate phrase, many of the men in my unit started calling them UTCs or Untrained Combatants, there is no such thing as "innocent" in a war zone these days. Does that make what that Marine did okay? Hell no! My squad and I were listening to the results on leave at K-Bay and almost all of us said "what the **** " when they were acquitted.

No Kim Dotcom (yes, really) AKA Kim Schmitz is not currently serving any jail time. He wasn't even arrested in the US but in New Zealand and had additional indictments on him in Hong Kong, the Netherlands, Germany and Canada as well. So not just the US.

Wuterich was pretty much only convicted in a court of public opinion. The Marines attempted to bring him up on charges of murder, then negligent homicide but finally landed on involuntary manslaughter and gave him a plea deal....for negligent dereliction of duty. That resulted in a reduction to the rank of private and 1/3rd pay for three month. Trust me, if the military thinks it has you for crime like that, you don't get a slap on the wrist. There was no evidence. But of course the media would never turn a small matter into a scandal....
