So this is what my professor said: If you're being robbed at gunpoint and you manage to steal the weapon the outcome can vary. If the robber goes to the police and claims his gun was stolen and confront you about it and do an investigation and it leads them to find out you were robbed at gun point by this person, the gun will be evidence in the trial if you choose to press charges (if it even goes to trial). The other out come is you get to keep the weapon because most robbers will not go to the police to report a stolen weapon if they know how it got stolen and know it will lead to their arrest.

In this case it's an act of defense, so yeah it's perfectly legal, as long as the gun is turned into police.

Well, stealing is stealing no matter what the person does to you. Just like it most states, its illegal to booby trap your car to prevent theft. Like, shocking door handles, or a spear..

And in this case, he would be in possession of someone elses gun (most likely stolen in the first place) So he wouldnt be able to keep it either way. If it was the criminals legally owned gun, or one that was stolen, serial number scratched off etc...

Revenge isnt always legal.

You know I've wondered the same thing for awhile now, I just started college recently and I'm majoring in Criminal Justice. I'll ask my professor on Friday and I will get back to you.
