$3 an hour is WAY less than minimum wage ANYWHERE in the country. If you know of someone making this shoddy amount, you need to call them out on this. It is ILLEGAL to pay someone under minimum wage, tips or no tips. They have a right to take it personally when no tip is made if they did in fact work above and beyond their job. People seem to think that a tip is owed to someone just because they did their job well, nowadays. A tip should be given to those who go above and beyond. (Unless like I do all to often just feel generous.)

Dude, google minimum wages for tipped employees. Different states are different, you're both right. As a bellboy in FL last year I made 4.65$ an hour from the hotel.......

Actually it is legal to pay below minimum wage, but only if you get tips.

I will correct myself in one aspect. It IS legal to pay under minimum wage for a few certain jobs, but food service is not a case.

There is no one particular standard "minimum wage". Rather the idea of "minimum wage" is the lowest amount an employer can pay a particular class of employees.



It's this "class" of employees that results in your question. Very specifically, "tipped employees" are a class of employee for which the standard federal minimum wage does not apply. Instead, employers must pay a tipped employee at least $2.13 / hour. HOWEVER, the law also states that if an employee's wage plus that employee's tips do not equal at least the standard minimum wage (currently $5.85 nationally, higher in some states), the employer must make up the difference.



Therefore, it is never correct to state that "waitresses make less than minimum wage." No, they don't. Their NORMAL hourly wage may in fact be less than minimum wage, but the amount of money they earn from wages and tips will always be at least minimum wage (or if not, the employer is breaking the law).

So? And my money to pay the food in the first place comes from trees or what? If the waiter/ess is friendly I am gonna tip her but if not (what mostly is the case) then she won't receive more than the spare change. And even if I give a tip 5 dollar is maximum imo.

I see both sides here. She got stiffed hard, 5$ for a $138 ticket might as well not even be a tip. Venting about it on facebook, however, seems to be a stupid idea, and I'm not a big fan of that sense of entitlement either. But I've never been a waiter, so I can't judge how stressful the job really is (I've heard it sucks **** though).

Waiters and waitresses, especially at a franchise like chili's, live off tips. Restaurants get away with paying below minimum wage because of this. If you order $138 worth of food, and you only tip $5, either she was a terrible waitress to you, or you are just a ******* douchebag.

This is so ****** up. Waiters are paid under $3 an hour, and we use the tip system so that good waiters make more, bad waiters make less (some places make waiters split the tip and that just defeats the whole point). Unless your couldn't eat your meal you tip 20%, that's just how it works. I completely understand why she was angry, and I would have been to. Have you never exaggerated? I'm sure she wouldn't actually spit in someone's food, but honestly I wouldn't blame her if she did. You sir, are a humongous douchebag.
