That's true. Saying that they're "looking for [x] rather than you even though [x] is more qualified," warrants you to take them to court. Even if [x] would "fit in" better or "get along" better with the people at the workplace, if there isn't any real reason to hire [x] over you other than the fact that [x] is a certain race or gender, it's discrimination. This can be averted by employers by simply saying that they aren't hiring them for some other reason or just not flat out telling the person that they're not hiring them because of their race or gender.

That varies country to country. I can speak to the law in Canada however (And given that it's derived from British law, it's probably similar there).

In Canada you can record somebody without their knowledge provided at least one member of the conversation is aware that it is being recorded.

Wear a wire? That's A-okay (unless you forget you're wearing a wire, then nobody is aware the conversation is being recorded)

Give a wire to your buddy? also A-okay

Record a conversation when you're not physically where the conversation is taking place (and nobody there knows it is being recorded who is there). Nuh-uh buddy that's illegal unless you're law enforcement and have a warrant.

You bring what evidence you have to a judge and ask them for a warrant. If they think you have enough to go on, then they'll authorize a wiretap/wire/whatever to get some more concrete stuff. The Constitution is very clear on your right to privacy, which is why warrants are needed. It's an important protection, even if it mildly inconveniences police.

In Britain, there are special business laws in place where you are not allowed to discriminate against people because of their age, sex etc. (Obviously you are allowed to turn down incompetent/incapable recruits.) So this is illegal and they can be sued for it.
