Not as illegal as shooting someone.
even in cases of self defense a shooting becomes classifiable as justified. Same goes if it's a warning shot.

How dumb do you have to be though to go "Yeah I was gonna mug this dude but he pulled a gun and fired a warning shot- please go arrest him officer"

You really don't know about the rush to the courthouse thing do you lol. It's basically where if a criminal is stopped, hurt, harmed or whatever, they will try and call the police first. So while the legit gun-owner who just fired the warning shot, saw the mugger hoof it thinks 'oh well that is dealt with, time to go home and make some waffles' the mugger runs off, calls 911 and reports that you fired at him like a crazy person. Now you're gone and have 'fled the scene'.

It's actually really common. You have a concealed carry, some guy tried to mug you, you show your piece and he hoofs it, calls the cops and reports that you threatened him.

The idea behind the 'rush to the courthouse', is they are basically trying to avoid getting in trouble themselves, so they rush to report a 'crime' first. It helps that the cops tend to take the side of the guy who calls them first. So unless you have actual proof in what happened you could be the one getting in ****.

Best course of action is the second you've fired your firearm (even if the guy gets away) or shown your piece to a mugger, you should instantly call 911 and report what just happened. It will save you so much trouble in the long run.

Criminals aren't known for routinely calling the police. Also all this only works assuming they know who you are.
The scenario you mentioned is rare, and who doesn't call the cops if someone tries to mug you/ break in?

It's that not everyone calls instantly. And it depends, if you stick around because you were doing something. Like if they call the cops and say 'a white guy with a red hoodie and blue jeans just pulled a gun on me I'm at 6th and lawrence'. Well assuming you don't have a car next to you or are planning on sprinting home. You will be in the area when a cruiser stops by. Now unless there are cameras or witnesses (which they probably won't be for a mugging), it looks really bad on the victim. What proof does the victim have? They have a gun that has been discharged and no proof that the other guy drew a knife to provoke him. It turns into a he says he said. But if one person can show more truth (guy has a gun on him vs guy who can chuck away a ****** knife) it looks bad for the vic. Even worse if they were a bit shook up and didn't call the cops instantly. Which is why I said it's best to be prepared and the instant everything calms down you should call the cops and report what happened.

Now I'm not saying that literally every criminal does this, but it isn't exactly rare. Paul Harrel talks about it in some of his presentations.

This happened to the grandfather of one of my friends. Somebody was in his backyard in the middle of the night and he shot the ground near them and they ran off. A few minutes later an officer showed up and they ended up giving him a ticket for discharging a firearm in the city limits.

City ordinance fines range from $5-$1000 depending on the severity.
Shooting a trespasser is going to be a lot more expensive- because you are going to court even if it's ruled justifiable.

Paying a fine is better than an attempted manslaughter charge. In general you are going to have to prove that you are under threat of bodily harm to justify pulling the trigger. That's why I favor a pump shotty for home defense. That slide racking a shell is as good as a warning shot and won't get you into trouble on your property.

Sucks about G-pa, but he likely knew the consequences and didn't want to actually kill anyone.

This is true for the yard, but had they entered the house he would have had a lot more freedoms and protection. I live in NC so it is a Castle Doctrine State.

Word. MN is as well. I think they are on the verge of passing stand your ground too.
MN is a little weak on use of force at the moment. technically you can shoot an intruder inside your house only to "stop a threat" not simply to shoot someone because they broke in.
Which is another reason why I use a shotgun as a home defense. Shouldn't have to shoot twice= crisis averted.

It ends up being classified as "negligent discharge of a firearm" I only know this because I was charged with a misdemeanor for firing a warning shot in Colorado.
